You will not receive any unsolicited emails or mailings.
When you visit a website, you disclose certain information, such as your Internet Protocol (IP) address and the time of your visit. This site, like most other sites, records this basic information about visits to our site such as: browser type and operating system, tracking the number of visitors to the site, and understanding how visitors use the site. Terms and Conditions
The following Terms and Conditions of Service apply to all artwork, graphic design, print and services provided by HIHO Design, LLC.
All design work is carried out by HIHO Design, LLC on the understanding that the client has agreed to abide by HIHO Design, LLC's terms and conditions.
Copyright of all graphic design work including copy, concepts, ideas, proofs and illustrations (unless specifically released in writing) is retained by HIHO Design, LLC until after all invoices have been settled.
If multiple design concepts are submitted to the client, only one concept is deemed to be given by HIHO Design, LLC as fulfilling the contract. All other artwork designs remain the property of HIHO Design, LLC, unless agreed upon in writing.
At the time of proposal, HIHO Design. LLC will provide the client with a written estimate or quotation. A copy of the written estimate or quotation is to be signed and dated by the client to indicate acceptance and should be returned to HIHO Design. LLC. No work on a project will commence until the acceptance has been received by HIHO Design. LLC.
Design and Printing Fees
Fees for design or contracted printing services to be provided by HIHO Design, LLC, will be set out in a written estimate or quotation, along with a schedule for payment, that is provided to the client. At the time of the client's signed acceptance of this estimate or quotation, indicating acceptance of the Terms & Conditions, a non-refundable deposit of 30% of the quoted fee will become immediately due. Work on the project will not commence until HIHO Design, LLC has received this amount. The client agrees that changes required over and above the estimated work will be liable to an additional hourly charge. HIHO Design, LLC will advise client in a timely manner if, for any reason, the initial quotation has been exceeded.
The client will be asked to provided artwork sign off prior to print/publication/artwork delivery. At this time, HIHO Design. LLC will provide an invoice and the remainder of the fees due will become payable upon receipt. Accounts which remain outstanding for 30 days after the date of invoice, will incur an extra charge of 2% per month of the outstanding amount. Payments may be made by cash, check (payable to HIHO Design, LLC) or PayPal.
Copyrights and Trademarks
By supplying text, images and other data to HIHO Design, LLC for inclusion in the client's brochure or other medium, the client declares that it holds the appropriate copyright and/or trademark permissions. The ownership of such materials will remain with the client, or rightful copyright or trademark owner.
Any design, copy writing, drawing or idea created for the client by HIHO Design, LLC is licensed for use by the client only and may not be modified, re-used, or re-distributed in any way or form without the express written consent of HIHO Design, LLC.
Any artwork, images, or text supplied and/or designed by HIHO Design, LLC on behalf of the client, will remain the property of HIHO Design, LLC, excluding Templates for client use or Logo design (in which case full copyright will be passed to the client upon receipt of full payment).
The client may request in writing from HIHO Design, LLC, the necessary permission to use materials (for which HIHO Design, LLC holds the copyright) in forms other than for which it was originally supplied, and HIHO Design, LLC may, at it's discretion, grant this. Such permission must be obtained in writing before it will allow any of the aforesaid artwork, images, text, or other data to be used. HIHO Design, LLC reserves the right to charge fees for additional usage.
Should HIHO Design, LLC, or the client supply an image, text, audio clip or any other file for use in a website, multimedia presentation, print item, exhibition, advertisement or any other medium believing it to be copyright and royalty free, which subsequently emerges to have such copyright or royalty usage limitations, the client will agree to allow HIHO Design, LLC to remove and/or replace the file.
The client agrees to fully indemnify and hold HIHO Design, LLC free from harm in any and all claims resulting from the client not having obtained all the required copyright, and/or any other necessary permissions.
The client also agrees that HIHO Design, LLC holds no responsibility for any amendments made by any third party, before or after a design is published.
Design Project Duration
Any indication given by HIHO Design, LLC of a design project's duration is to be considered by the client to be an estimation. HIHO Design, LLC cannot be held responsible for any project overruns, whatever the cause. Estimated project duration should be deemed to begin the date that cleared funds of the deposit are received by HIHO Design, LLC.
Design Project Completion
HIHO Design, LLC considers the design project complete upon receipt of the client's payment in full for design services and any other services such as printing or publishing contracted on the client’s behalf.
The customer agrees to allow HIHO Design, LLC to place all designs on HIHO Design, LLC's own website for portfolio and demonstration purposes and to use any designs in its own marketing and promotion unless agreed otherwise.
Cancellation of design orders may be made by telephone but must be followed up with a formal email or letter to HIHO Design, LLC, PO Box 2286, Corrales, NM 87048. The client will then be invoiced for all work completed over and above the non-refundable deposit that will have been made at the time of first ordering. The balance of monies due must be paid within 30 days.
Client agrees that once he/she approves a project for printing, the full contracted printing fee is incurred and cannot be canceled or refunded.
HIHO Design, LLC makes no warranties of any kind, express or implied, for any and all products and/or services that it supplies. While HIHO Design, LLC takes precautionary steps to investigate recommended materials, HIHO Design, LLC accepts no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The client agrees not to hold HIHO Design, LLC responsible for any such loss or damage.
HIHO Design, LLC reserves the right to use the services of sub-contractors, agents and suppliers and any work, content, services and usage is bound by their Terms and Conditions. HIHO Design, LLC will not knowingly perform any actions to contravene these and the client also agrees to be so bound.
HIHO Design, LLC and its clients agree to comply with Printers Terms and Conditions which include disclaimers for non-completion on time and the flexibility to supply quantities within 10% of the total ordered. HIHO Design, LLC recommends that if an exact quantity is required, then 10% extra is added to the quantity and extra time made available should the job be delayed.
Any claim against HIHO Design, LLC shall be limited to the relevant fee(s) paid by the client.
Acceptance of Quotation and Terms and Conditions
The placement of an order for design and/or any other services offered by HIHO Design, LLC and validated by the client's signature on the estimate or quotation, constitutes acceptance of the estimate or quotation and agreement to comply fully with all the Terms and Conditions and forms a Contract for Business between the signatory and HIHO Design, LLC.

These Terms and Conditions supersede any previous Terms and Conditions distributed in any form. HIHO Design, LLC reserves the right to change any rates and any of the Terms and Conditions at any time and without prior notice. Any changes to these terms and conditions will be posted to this site.
